Your attorney won’t settle for less than you deserve.
One thing to keep in mind is that the word “settlement” implies that you are taking less than your case might be worth. Making this decision can make sense, as it spares you potentially years of litigation and allows you to move on with your life. However, getting anything close to full compensation for your damages usually requires filing a lawsuit, and many times requires going to trial.
That doesn’t mean every case goes to trial – far from it. But showing the other side the strength of your case, and your willingness to go to trial if necessary, can sometimes change what they are willing to pay. You always have the power to resolve your case at any time. Cases can be settled before a lawsuit, during a lawsuit, on the courthouse steps the morning of trial, and even after a trial while the jury is deliberating.
